Waiver
Volunteer Release and Waiver of Liability:
I, ____________________ (“Volunteer”) desire to provide volunteer services for the Black Mountain Blues Society, a North Carolina Non-Profit Corporation (“Company”).
Scope of Relationship. I understand that the scope of my relationship with Company is limited to a volunteer position. No compensation will be provided in return for services provided by me, nor will I be entitled to any employee benefits. I understand that I am responsible for my own insurance coverage in the event of personal injury or illness as a result of my volunteer services to Company.
Release and Waiver: I hereby release and forever discharge and hold harmless Company and its successors and assigns from any and all liability, claims and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from my volunteer services with Company. I understand that this release discharges Company from any liability with respect to bodily injury, personal injury, illness, death, or property damage, whether caused by the negligence of Company or its officers, directors, employees, agents, or otherwise.
No Insurance. I understand that Company does not provide medical, health, worker’s compensation or disability benefits or insurance, nor does Company provide any financial or other assistance, in the event of injury or illness.
Medical Treatment: I hereby release and forever discharge Company from any claim whatsoever which arises or may hereafter arise on account of any medical treatment or services, including first-aid or similar services, rendered in connection with my volunteer services with Company.
Assumption of Risk. I understand that participation in volunteer activities involves certain risks, including but not limited to serious injury and death. I am voluntarily participating in the volunteer activities with knowledge of the danger involved, and I agree to accept all risks of participation.
Indemnification. I agree to indemnify and hold harmless the Company for all claims, accusations, notices, judgments, rulings, liabilities or expenses arising out of my actions, inactions, errors, acts, or omissions as a volunteer.
Photo and Media Release: I hereby grant the Company and its affiliates the unrestricted, irrevocable, royalty-free, and perpetual right to use, reproduce, display, distribute, and publish any photograph, video, audio recording, or other media depicting my image, voice, likeness, or name taken or recorded during or in connection with my volunteer service, for any lawful purpose, including marketing, publicity, educational, archival, and promotional uses.
I also grant the Company the right to use, edit, reproduce, and publish any media (including photographs, recordings, or other materials) that I voluntarily provide to the Company without attribution or compensation. I acknowledge that I will not receive credit, notice, or compensation for such use, and I waive any right to inspect or approve the final product.
Miscellaneous: I understand that this document is a contract which grants certain rights to, and eliminates the liability of, the Company. This Release and Waiver of Liability shall be governed by the laws of the State of North Carolina. This Release and Waiver of Liability is intended to be as broad and inclusive as permitted by law. In the event any provision of this Release and Waiver of Liability shall be held to be invalid by any court of competent jurisdiction, the invalidity of such provision shall not otherwise affect the remaining provisions of this agreement, which shall continue to be enforceable.
By signing below, I express my intent to enter into this Release and Waiver of Liability, and I do so willingly and voluntarily. I understand that by signing this form, I am giving up legal rights and remedies. I am over the age of 18.

The Festival will be held in downtown Black Mountain, NC.

Date(s): September 26-28
Event Hours of Operation: 2 pm September 26th - 6 pm September 28th..
Volunteer’s Shift: You will be assigned your shift by a separate email and given a check-in location.
You should arrive at your check-in location 30 minutes prior to the start of your shift. Volunteers are expected to stay for the entire duration of their shift. If you are unable to be available for your scheduled shift, please let the Host or Promoter know as soon as possible so they have time to find someone to cover your shift.
Professional Conduct and Site Appearance:
All Volunteers must dress appropriately; shoes, pants/shorts and shirts are required. You will be provided with a Volunteer T-Shirt to wear.
Smoking is not permitted except in designated smoking areas.
Volunteers will conduct business in a professional, courteous, and ethical manner and without regard to race, color, gender/sex, sexual preference, religion, age, disability, genetic information, national origin, veteran status, income level, limited English proficiency or political affiliation.
Alcohol Service Guidelines:
Alcoholic beverages may not be sold or served to persons less than 21 years old.
Do not sell or serve alcoholic beverages to intoxicated persons. If you are uncomfortable making this call, please ask for assistance from the event Host or Promoter.
Any pouring location is considered a “point of sale” and is subject to all NC ABC statutes and regulations.
If volunteer servers do not ask for identification (ID), there will be no defense to a criminal charge if alcohol is sold to an underage person. Forms of ID that are defensible in court are:
Current Driver’s License
US Military ID
ID Card
Official Passport
The verification of ID should occur at the point of sale, even if a 21+ event or IDs are checked at the gate. Wristbands, handstamps, and other comparable markers are NOT considered proof of age.
Food and Beverage:
Volunteers should wash their hands frequently, particularly after eating, drinking, or using the restroom.
Keep all meat, poultry, fish, dairy products and other potentially hazardous food at the proper temperatures.
Protect the food by keeping it covered, or behind/under a shield.
Wash and sanitize contaminated utensils and food contact surfaces immediately.
Sick or ill (i.e. cold, flu etc.) individuals shall not handle, prepare, and/or serve food products.
Keep toxic items such as cleaning supplies, lighter fluids, sanitizers, etc. away from food and food preparation areas.
Alcohol Consumption. Volunteers may not consume alcoholic beverages before or while working at the event, even for quality control purposes.
Hazardous Materials. Volunteers agrees not to bring onto the event property any material, substances, equipment, or object which is likely to endanger the life of, or to cause bodily injury to or death of, any person on the event property, or which is likely to constitute a hazard to property thereon, without prior written approval of the event promoter. The promoter shall have the right, in its sole and absolute discretion, to refuse to allow any such material, substances, equipment, or object to be brought onto the event property and the further right to require immediate removal therefrom if found thereon.
